Yes, the fact that the company is out of business is not important as you are covered for your work injuries by the Workers’ Compensation insurance policy in place at the time of your injury, so as long as your former employer had insurance, you are covered.

Secondly, you have two (2) years from the date of the accident or from the date of your last medical treatment authorized by the Workers’ Compensation carrier to file a Workers’ Compensation claim; however, if you have not reported the accident or have not received medical treatment during this period, you might technically have a case but be unable to win it.
