I was hurt on the job about one (1) year ago and the company is now out of business can I still make a Workers’ Compensation claim?

Yes, the fact that the company is out of business is not important as you are covered for your work injuries by the Workers’ Compensation insurance policy in place at the time of your injury, so as long as your former employer had insurance, you are covered.
Secondly, you have two (2) years from the date of the accident or from the date of your last medical treatment authorized by the Workers’ Compensation carrier to file a Workers’ Compensation claim; however, if you have not reported the accident or have not received medical treatment during this period, you might technically have a case but be unable to win it.
For the above reasons, you should consult an attorney immediately to determine: 1. if your former employer had Workers’ Compensation insurance on the date of your accident and 2. whether you have sufficient medical proofs to show you were injured on the job.Posted by Daniel Levy Posted on 15 Jul
