Adjustment of Status (AOS) is the process used when the foreign spouse is already physically present inside the United States after a lawful entry. The entire process takes place in the U.S. using Form I-485 and ends with an interview at a local USCIS field office (such as Newark). Consular Processing is used when the foreign spouse lives overseas; the approved I-130 petition is processed through the National Visa Center (NVC) and ends with an interview at a U.S. embassy or consulate in the spouse’s home country.
It depends on how they entered the country. If the individual entered the U.S. lawfully (with a valid visa, border crossing card, or visa waiver) but overstayed, they are generally eligible to adjust status through marriage to a U.S. citizen without leaving the country. However, if they entered without inspection (EWI), they generally cannot adjust status inside the U.S. unless they qualify for a specialized waiver (such as an I-601A provisional unlawful presence waiver) or humanitarian protection (such as VAWA).
First, locate them using the official ICE Online Detainee Locator System (ODLS) using their Alien Registration Number (A-Number) or full biographical details. Second, note the facility where they are being held (such as Elizabeth Detention Center). Third, do not allow them to sign any “Voluntary Departure” or “Stipulated Removal” documents without an attorney. Finally, contact an immigration lawyer immediately to evaluate whether an emergency bond motion or federal Habeas Corpus petition can be filed before ICE attempts to transfer them out of state.
Yes, provided the state juvenile or family court finds that the child was abused, neglected, or abandoned by at least one parent, and that reunification with that parent is not viable. You do not have to prove that both parents abandoned the child; establishing abandonment or abuse by one parent in a New Jersey Family Court order is sufficient to meet the statutory prerequisite for SIJS.
